Overview
A global luxury menswear brand engaged Alinea Customs to provide specialist customs and trade compliance support following intervention by U.S. Customs and Border Protection (CBP) in relation to tariff classification for footwear. Beyond the immediate classification issue, which was a result of regional variations between the (EU TARIC) classification provided by the Italian manufacturer, and the US Harmonised Tariff Schedule (HTS) the engagement addressed wider tariff exposure, supply-chain structuring, and customs valuation governance across the Client’s international operations.
What began as a response to a single regulatory trigger became an opportunity to build durable, audit-ready compliance controls spanning the UK, EU, and U.S. markets.
The Challenges
The Client faced three interconnected challenges, each carrying both financial and compliance risk.
Tariff classification. The Client’s UK, EU, and U.S. tariff classifications needed independent review and validation. Key concerns included potential misclassification risk, an over-reliance on suppliers’ classification data, and the absence of robust internal classification controls aligned with regional compliance principles.
Packaging and supply-chain structuring. Packaging materials sourced internationally — particularly from China — created meaningful tariff exposure. The Client needed a comparative analysis of tariffs and cost exposure across alternative import routes, assessing the compliance and financial implications of different routing models in accordance with the World Customs Organization’s General Interpretative Rules (GIR).
Customs valuation. A significant portion of goods moved between the Client’s own branches, where no sale takes place. The Client required a formal customs valuation methodology for these inter-branch transfers, aligned with WTO customs valuation rules and consistent with its transfer-pricing approach, to strengthen audit defensibility across jurisdictions. Internal training was needed to embed a lasting customs valuation framework.
Our Approach
1. Tariff Classification Review
Alinea Customs conducted a targeted review of the Client’s inventory classifications, covering approximately 4,000 products across UK, EU, and U.S. tariff nomenclatures. The review identified potential misclassification risk and prioritised the areas of greatest exposure. Where data material to classification decisions was missing, it was requested from suppliers and the in-house design team. The result was a set of orderly ERP files reflecting regional variants in classification and meeting the requirements of each export region.
2. Regulatory and Legal Alignment
Alinea Customs assessed the Client’s classification practices against U.S. CBP requirements, including the Customs Modernization Act, Informed Compliance principles, and the Harmonized Tariff Schedule of the United States (HTSUS), ensuring alignment with international classification standards.
3. Operational and Cost-Impact Analysis
Alinea Customs evaluated the Client’s exposure to U.S. tariffs on packaging supplied from China and produced a structured table of reviewed supply-chain and packaging routes. We then carried out a cost-benefit analysis applying the World Customs Organization’s General Interpretative Rules (GIR) to assess tariff exposure and operational efficiency — examining, in particular, whether arranging packaging and labelling within the UK and Europe could optimise cost-efficiency.
4. Internal Customs Valuation Planning
We implemented customs valuation planning procedures aligned with the World Trade Organization’s Customs Valuation Rules. This work addressed sales for export, inter-branch transfers of goods, movements between related parties, and the intersection with transfer-pricing. We addressed best practice across the regional variations between the U.S. and Europe and provided in-house training to support consistent application.
The Solution
Tariff Classification: Addressing Regional Variations for ERP Use
Alinea Customs delivered a structured, evidence-based compliance review aligned to the Client’s international operating model. This included tariff classification across regional markets, directly addressing the risk of relying on suppliers’ data, with a targeted approach to product categories subject to regional variation. Findings were documented in a clear, practical format that highlighted potential non-compliance, priority risk areas, and recommended corrective actions.
Governance, Valuation, and Audit Readiness
To support long-term compliance, Alinea Customs developed a tailored customs valuation framework addressing inter-company movements where no sale occurs. This included the creation of internal guidance and controls aligned with international valuation principles, supported by targeted staff training to embed consistent application in day-to-day operations.
The Result
The Client moved from the reactive position of responding to a CBP intervention, and realising that they were entirely reliant on HS classifications provided by their suppliers, to addressing regional variations across their ERP systems, and thereby benefiting from reduced intervention from customs authorities. With validated classifications across three regions: their factories in the European Union, their distribution hub and head office in the United Kingdom, and the United States; their key export market, they implemented the foundations of a robust customs compliance system. Furthermore, through provision of inhouse customs training, the global fashion company benefited from a defensible valuation methodology for inter-branch transfers, an optimised packaging supply chain. Having provided the education resources to internal staff, alongside quarterly training, the Client is now comprehensively equipped to manage tariff exposure and withstand customs audit scrutiny across its international operations.
